An illegal Mexican immigrant who admitted punching and sexually assaulting a teenager is about to be shipped out of the country, according to authorities.

Israel Cervantes Gonzalez, 31, pleaded guilty Monday to misdemeanor indecent assault and simple assault. In return,

several felonies, including rape, aggravated indecent assault and sexual assault, were dismissed.

Lehigh County President Judge William H. Platt placed Gonzalez on two years’ probation, but a federal detainer was immediately slapped on Gonzalez because he’s here illegally, according to authorities.”The plea was for probation so he can be released to immigration authorities who have a detainer against him,” Chief Deputy District Attorney Matthew Falk said.

Falk said Gonzalez will remain in Lehigh County Prison until U.S. Immigration and Customs Enforcement officers pick him up in six to 10 days. Gonzalez will be taken to a federal facility in Reading to begin deportation proceedings, Falk said.

According to the arrest affidavit:

Gonzalez was charged in September 2009 after the 17-year-old, who is married with children, told authorities Gonzalez had sexually assaulted her. She said Gonzalez, a family friend, crept up behind her around 10 p.m. Sept. 22, 2009, in a kitchen in center city Allentown and began touching her.

She said she told him to stop and he punched her in the face, giving her a bloody nose. She said Gonzalez then pulled her into a bedroom by the hair and continued to hit her. He then held down her arms, pulled off her pants and underwear and raped her.

She said Gonzalez fled in her father’s car.

Gonzalez has served almost 11 months in Lehigh County Prison under $150,000 bail since his arrest Sept. 25, 2009, according to court records.

Judicial Watch filed a Freedom of Information request to see White House visitor logs. The Secret Service claims White House visitor logs are not subject to Freedom of Information requests and so they are not releasing them. (This happened appx. 10 days ago)

Now this is the same president who vowed to CHANGE the stonewalling and secretive techniques of the Bush administration and be more TRANSPARENT?? (Obama lawyers are LITERALLY using the very same “state secrets” argument George W. Bush used)

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that the Obama Justice Department advanced the erroneous claim in an April 21, 2010, court filing that Secret Service’s logs of White House visitors are not subject to the Freedom of Information Act (FOIA). As Judicial Watch noted in its original complaint filed on December 7, 2009, this claim “has been litigated and rejected repeatedly” by the courts.

The Justice Department filing comes in Judicial Watch’s FOIA lawsuit seeking records for all visitors to the White House from January 20, 2009, to the present. On February 22, 2010, Judicial Watch filed a “Motion for Partial Summary Judgment” in its lawsuit, noting that the rule of law and court precedent do not support the position of the Obama administration:

“At issue here is whether Secret Service visitor logs are agency records subject to the Freedom of Information Act (‘FOIA’), 5 U.S.C. § 552. To date, every court that has reached this issue has concluded that the requested documents are agency records and must be processed in response to a properly submitted FOIA request. As no disputes of material fact exist as to the nature of the records, summary judgment as to this straightforward legal issue should be entered now.”……………….However, Obama Justice Department lawyers countered in their court filing that “the district court cases on which [Judicial Watch] relies for a contrary conclusion were incorrectly decided,” and stuck by their argument that the visitor logs “are not agency (Secret Service) records subject to FOIA.” Justice Department lawyers also repeated the blanket argument that to release these records could compromise national security and praised the Obama administration’s efforts to “voluntarily” release some White House visitor logs to the public. (In 2009, the Obama White House began to release, in order to settle related litigation, a select number of Secret Service visitor logs to the public. However, tens of thousands of other records continue to be withheld in defiance of FOIA law.)

Police searching for a suspect in the fatal shooting of a Millard County sheriff’s deputy did not find the man in a Salt Lake City shed Tuesday morning and now have added a second person of interest in the case.

Deputy Josie Greathouse Fox was gunned down about 1 a.m. Tuesday during a traffic stop a mile east of Delta, and a statewide manhunt for the suspect had narrowed down to a few blocks of west Salt Lake City.

However, police used tear gas in a shed and travel trailer where Roberto Miramontes Roman was suspected to have been and found no one inside. Roman is described as a 37-year-old Latino, 5-foot-7, 130 pounds, with brown hair and brown eyes.

The second person of interest is Ruben Chavez Reyes, a 36-year-old who may know or may have assisted Roman, according to Utah Highway Patrol Sgt. Jeff Nigbur.

Police found a gray 1995 Cadillac Deville connected to the men in Nephi and are headed there to process it for prints and other evidence.

Fox, a mother of two, had been with the Millard County Sheriff’s Department five years. Her body was found by a second deputy, who was responding to her request for backup.

Roman is possibly armed with an AK-47 assault rifle, and is considered dangerous. Anyone with information on Roman’s whereabouts is urged to immediately call 911.

“We have information that he’s not going to be taken alive,” Nigbur said.

Roman has a significant criminal history, including drug offenses, and a court-ordered illegal immigration-related deportation.

Millard County officials said the suspect vehicle, an orange Corvette, had been stopped as part of an investigation into recent thefts. The suspect had sped away from the scene by the time the second deputy arrived.

The search the suspect quickly focused to Salt Lake City, where police found a vehicle — believed to be the Corvette — near 300 South and 1100 West.

By 7 a.m., SWAT officers were seen in the area of 300 South and 1100 West. Two local elementary schools — Guadalupe and Franklin — were closed and traffic through the area blocked while officers went door-to-door, searching for the suspect.

Nigbur said three SWAT teams were deployed in the area, focusing on “two or three” homes believed to be occupied by relatives of the suspect. No neighborhood evacuations were immediately ordered, however.

Roman has a criminal history beginning in 1992 with a misdemeanor drug distribution charge to which he pleaded guilty in Fillmore’s 4th District Court.

Then in 1996 and 1997, Roman was charged in Millard County with a handful of felonies in two different cases, including drug charges, receiving stolen property and a weapons count.

He resolved the cases by pleading guilty to one count of third-degree felony drug possession and one count of second-degree felony drug possession with intent to distribute.

Utah Board of Pardons and Parole spokesman Jim Hatch said Roman was sentenced to prison for up to 15 years in June 1997.

Roman was released into the custody of immigration authorities on Sept. 15, 1998, and deported.

Court records show that at the time the crimes were committed, Roman was a resident of Delta. All three cases were investigated by the Millard County Sheriff’s Office.

Meanwhile, in Millard County, law enforcement ordered closure of U.S. 50 in both directions just east of Delta as their investigation into the slaying got under way this morning. The road has since been reopened, according to the Utah Department of Transportation.
